Are Part-Time, “Hourly” Lawyers a Win-Win?

If you’ve had the chance to read the new book, Staying at Home, Staying in the Law: A Guide to Remaining Active in the Legal Profession While Pursuing Your Dreams, you know the reasons why the author, Julie Tower-Pierce, takes the view that “hourly” (with no or limited benefits provided) work arrangements are a win-win for both firms and the employees who seek those arrangements.

While it’s sometimes argued that “hourly” lawyers (often women who are mothers), short-change themselves in the end (e.g., career potential, retirement savings), there are many, many lawyers out there, including women and men both with and without children, and dissatisfied lawyers, who are incredibly attracted to hourly opportunities. For many, flexibility outweighs benefits and employer frills.

For some, hourly work gives them the opportunity to accomplish their dreams. For example, the lawyer/mom who wrote to Darling Hill today wants to be there for her children’s afternoon carpool. For another lawyer, she’s happy getting paid hourly without (health insurance) benefits because she’s already covered under her spouse’s plan.

Hourly lawyers can be a huge cost savings for law firms, beyond overhead savings. In this economy, hourly lawyers could be key to helping a firm stay afloat. For example, firms who use hourly lawyers can potentially take on work that might otherwise get turned away because of lower billing rates. In the booming times to come–there will be that time again–hourly lawyers and opportunities could be key to attracting new business and retaining loyal clients, not to mention retaining lawyers (think increased happiness on the job).

Firms can take on hourly lawyers as “freelance” or contract lawyers, using them appropriately as work ebs and flows, or hire them as permanent, part-time employees with set or flexible schedules.
